The family of a teenager critically injured when a tree fell in Jackson Square is suing the City of New Orleans.

Relatives of 17-year-old Gavin Cristea say the tree that fell on the bench he was sitting on earlier this month had been in poor condition for at least five years.

According to WVUE-TV/FOX 8, the lawsuit claims construction for the Jackson Square Renovation Project may have damaged the tree's root system and led to the incident.

The attorney for Cristea's family say the teen is still in the hospital with a severe brain injury.
